Privacy Policy

Thank you for using the Site and/or Services of Kambioo (“MBO”, “we”, “us”, or “our”). We take your privacy very seriously, and this Privacy Policy explains the ways in which we collect, use, disclose, and protect information relating to our Site and Services.

We endeavour at all times to keep your data accurate and secure, and to honour your data preferences with regard to receipt of direct marketing e.g. postal communications, email, mobile messaging and telephone calls.

Information We Collect Directly from You

Customer Account Information: When you sign up for a MBO Account, you are assigned a User ID (using your email address and password) and we collect and store that information. Collected information is data we have solicited in a form or obtained via cookies or by other means; stored information is collected information that has been subsequently deposited into our databases after collection. In addition to your User ID, we also collect and store your first name and last name. We may also collect and store your company name, telephone number, address, and certain other information about you that may be required by us to provide the Services or be disclosed by you during your use of the Services.

Customer Recipient Data: we also maintain data that has been generated via registration pages hosted on the Site by our customers, which we refer to in this Policy as “Customer Recipient Data.” Typically, Customer Recipient Data relates to individuals or entities who have opted in to receive email messages or other types of communications from our customers, and may include name, e-mail address, contact information, and other information. Under our policy customers must obtain a recipient’s consent on their registration pages prior to sending the recipient an e-mail or contacting them via other types of communications. We only use Customer Recipient Data on behalf of and under the instructions of our Customers. We do not use Customer Recipient Data for our own marketing purposes;

Log Data: When you use the Services, our servers may automatically collect and store information, including information that your browser sends whenever you visit a website. This log data may include, but is not limited to, your Internet Protocol (IP) address, the address of the web page you visited before using the Services, the operating system you are using, the date and time of your accessing the Services, geolocation information, type of device, cookie data, and browser signatures.

IP Addresses: We will log the IP address of any visitor to a webpage you create and publish using the Services in order to calculate traffic usage per Account and conversion rates per variant, investigate spam allegations and discrepancies in page statistics, as well as to ensure the security of the webpage, services, and related data. MBO never uses the IP address or other Personal Information of visitors to your pages to conduct marketing activities or promote the Services.

Cookies and Log Files: Cookies are small amounts of data that are transferred to your web browser by a web server and are used to collect and store information about a user. The ways we use cookies include, but are not limited to: tracking which webpage variant a visitor has seen, monitoring traffic patterns, and gauging the popularity of service options. Cookies also allow us to ensure that visitors see the webpage variant they expect to see if they return to the same website URL, and to calculate total visits and views per webpage, variant, Account, and client sub-account

Other Data: We may also collect information about customers or potential customers from our affiliates, from third parties, such as business partners, from our social media pages, during promotional events or from users who submit their information to MBO in order to subscribe to our mailing lists or receive information about MBO products and services.

Although the majority of our customers are businesses, some of the Customer Registration Data submitted or maintained by us may identify or relate to an individual (“personal data“), rather than a business. We will use such data in accordance with this Privacy Policy.

Use of the Site and Services signifies consent to MBO use of cookies, including and without limitation Third Party cookies that MBO may choose to use for analytics or other purposes. You agree that should you disable cookies on your browser, certain aspects of the Services may be unavailable to you, and that MBO is not responsible for any adverse effects arising from your browser or other computer or mobile settings.

You agree that you are responsible for adhering to all laws, policies, and other regulations in your relevant jurisdiction(s), including but not limited to all laws requiring that cookie use must be disclosed. MBO disclaims all liability in this area.

User Contributions: You may also provide information to be published or displayed on public areas of the Site and/or Services, or transmitted to other users of the Site and/or Services (collectively, “User Contributions”). Your User Contributions are posted and transmitted to others at your own risk. We cannot control the actions of other users of the Site with whom you may choose your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.

By maintaining an Account with us, you voluntarily consent to the collection, storage, use, and disclosure of Personal Information as specified in this Privacy Policy. Without limiting the foregoing, we may on occasion ask you to consent when we collect, store, use, or disclose your Personal Information in specific circumstances. These circumstances may include, but are not limited to, Trial Programs, Beta Tests, research and development, and other changes, updates, or additions to the Services. Sometimes your consent will be implied through your conduct with us if the purpose of the collection, storage, use, or disclosure is obvious and you voluntarily provide the information. We do not knowingly or intentionally provide the Services to, and will not knowingly or intentionally collect Personal Information from individuals under the age of consent (16 Years of Age).

How We May Use Information We Collect from You

We may use the information we collect from you to provide the Services to you and to understand, improve, and enhance the Services. This includes, but is not limited to, the right to conduct research, analyse trends, monitor traffic usage, and examine the ways in which our users engage with the Services.

We may use your Personal Information to respond to your questions or comments, including support-related. We also use your Account data to administer your Account and Account management.

Signing up for an Account with MBO constitutes implied consent to receive electronic marketing communication from us regarding our products, services, news, and events. You have the option not to receive this information. We provide an unsubscribe function within all electronic marketing communications, or will cease to communicate with you for this purpose if you email us at unsubscribe [@] kambioo.com and tell us not to communicate this information to you.

We may contact you to notify you about changes to the Services, and other important Service related notices, including but not limited to security and fraud notices, Service suspensions, and outages. These emails and messages are considered essential, non-marketing communications, and you may not opt-out of them.

We work hard to keep the Services secure and to prevent abuse and fraud. We may use your Personal Information as necessary to respond to security incidents, claims of any violation of our rights or those of any Third Parties, to protect the rights, property, or personal safety of you, us, our Customers, and the public, and as required or authorized by law.

How We May Disclose Information We Collect from You

MBO will only share your information with Third Parties in accordance with your instructions or as necessary to provide you with a specific service or otherwise in accordance with applicable privacy legislation. As a general rule, unless permitted in this Privacy Policy, we do not and will not sell, rent, share, or disclose your Personal Information without first receiving your permission.

It is your responsibility to ensure that your use of the Services complies with all data transfer, processing, privacy, and other laws and regulations within your local jurisdiction.

Your Rights
You have the right to access and edit your Account and Profile Information by logging into the Services and choosing to edit your Profile. You are able to upgrade, downgrade, and cancel your Subscription, enable and disable Third Party integrations, view your lead data, download a CSV file of your lead data for any date range, invite additional Users to your Account (depending on your Account level), and decide which permission level to grant each additional User.

You may request that your Account, including all leads, be deleted from our servers by contacting Customer Support by emailing support [@] kambioo.com and requesting deletion. This will “soft-delete” your Account. Soft-deletion retains your Account data in our secure database archive but flags it as deleted, preventing any further access, including the ability to log in or access pages or lead data. This is to deal with any requests such as subject access requests and legal enquiries that may arise after account deletion. Lead data held in our secure database archive will be deleted forever after one calendar month.

The Site may contain links to other websites. We are not responsible for the privacy practices or the content of such websites. We encourage you to read the privacy policy and terms of use of any linked websites, as their policies and practices may differ from our own.

Change of Ownership or Business Transition
In the event of a change of ownership or other business transition, such as a merger, acquisition or sale of our assets, your Account, including all Personal Information stored therein, may be transferred in accordance with applicable privacy laws.

Security
We will strive to prevent unauthorized access to your Personal Information, however, no data transmission over the Internet, by wireless device or over the air is guaranteed to be 100% secure. We will continue to enhance security procedures as new technologies and procedures become available.

We strongly recommend that you choose a strong, unguessable password, and that you do not disclose your password to anyone. If you forget your password, we will ask you for your email address and send you an email with instructions for resetting your password. At no time is a MBO employee able to view your password.

Please remember that you control what Personal Information you provide while using the Site and Services. Ultimately, you are responsible for maintaining the secrecy of your identification, passwords and/or any Personal Information in your possession for the use of the Site and/or Services.

Always be careful and responsible regarding your Personal Information. We are not responsible for, and cannot control, the use by others of any information which you provide to them and you should use caution in selecting the Personal Information you provide to others through the Site or Services. Similarly, we cannot assume any responsibility for the content of any Personal Information or other information which you receive from other users through the Site or Services, and you release us from any and all liability in connection with the contents of any Personal Information or other information which you may receive using the Site or Services. We cannot guarantee, or assume any responsibility for verifying, the accuracy of the Personal Information or other information provided by any third party. You release us from any and all liability in connection with the use of such Personal Information or other information of others.
